Ohio DUI and OVI Laws
In Ohio, the legal drinking age for alcoholic beverages is 21 years old. Based on evidence of reckless driving or another probable cause, a law enforcement officer can pull over any person suspected of driving or operating a vehicle while under the influence of alcohol or drugs and ask him to submit to a blood, breath, plasma or urine test to reveal his blood-alcohol content (BAC). To be charged with a DUI or an OVI, the results of the test must show that the person’s blood-alcohol level is above legal limit of 0.08 (for minor’s, the limit is 0.02; for operators of commercial vehicles, the limit is 0.04).
Those who refuse to submit to blood-alcohol testing, as well as those who tests indicate a blood-alcohol content greater than the given limit, will immediately have their licenses confiscated. For individuals with an excessive blood-alcohol concentration, officers will likely place them under arrest, and DUI/OVI charges will be filed.
It’s important to point out that, when DUI and OVI charges are filed against someone, there are two cases that the individual faces – one with the justice system and the other with the Registrar of Motor Vehicles – that operate independently of each other. While the criminal case in the justice system may result in a sentence of probation and/or jail time, the case with the Registrar of Motor Vehicles determines the length of time that the individual’s driver’s license will be suspended. Given the complexities of dealing with two concurrent cases, as well as the intricacies of OVI laws and the legal system in general, having the experienced Ohio DUI and OVI attorneys from Wright & Schulte LLC defending your rights is vital to resolving your case with minimal hassle while also dodging a potentially crippling sentence if convicted.
Ohio DUI and OVI Legal Defense
As soon as you are charged with a DUI or OVI, it’s critical you secure the services of a skilled Ohio DUI lawyer from Wright & Schulte LLC, particularly if:
- The DUI charge involves an accident.
- Someone has been injured as a result of the incident.
- Significant property damage occurred.
- You have a previous DUI conviction (or a criminal record).
We will immediately start mounting your defense and have had success in previous DUI cases arguing issues such as:
- An officer illegally pulling over a vehicle in the first place (The officer must have probable cause to pull over a vehicle and cannot do so on a whim.)
- Arresting officers failing to follow proper procedures before, during or after the DUI arrest
- Unreliable or inaccurate results of the field sobriety test
- Subjective interpretation of blood-shot eyes or other physical interpretations of intoxication (For example, blood-shot eyes may be the result of allergies or sleep deprivation and not intoxication).
Depending on the circumstances of your case, getting the DUI charged reduced to the lesser charge of “wet reckless” may be an option.
